Furthermore, the IBMDC does not choose the breeders who participate on our breeder's list. All breeders who, based upon the information that they voluntarily provide and affirm is accurate to the best of their knowledge, satisfy our minimum criteria and who pay a small administrative fee are included on the list. Thus, the fact that a breeder is included on the IBMDC breeder's list is not a guarantee, warranty, or other promise that this breeder is endorsed by this consortium or that the breeder's puppies will be free from health problems. In short, the consortium is not a brokerage and is not liable for any negligence, misrepresentation, or breach of contract claim that may arise between a buyer and a breeder who find each other through the IBMDC list.

We have neither the financial resources nor the ability to confirm all of the data that the breeders provide to us, although we plan to engage in random inspections of breeders' facilities and records from time to time. Likewise, breeders must check the accuracy of their information as posted on the consortium's list, and we will not be liable for any misprints, omissions, or other errors. We will, however, revise incorrect information as soon as the breeder brings the error to our attention.

As a result, because we are unable to verify the breeder provided information, we cannot be liable for a breeder's misrepresentation of fact. Indeed, the often-used phrase "caveat emptor," or "buyer beware" is good advice when purchasing a puppy.

The IBMDC cannot and will not indemnify anyone who is dissatisfied with a purchase made as a result of a contact made through our breeder's list. It bears repeating that the IBMDC does not provide this service in order to raise money, sell puppies, or endorse breeders, breeding programs or specific dogs. Unfortunately, we can only provide information, not guarantees of any nature. We trust, however, that the information that the IBMDC has assembled for the benefit of breeders, potential buyers, and Berner lovers everywhere will prove to be a valuable tool for the betterment of today's and tomorrow's Bernese Mountain Dogs."
